    Οι οικονομικοί φορείς που συμμετέχουν στη διαδικασία σύναψης της παρούσας σύμβασης απαιτείται να ασκούν εμπορική ή βιομηχανική ή βιοτεχνική δραστηριότητα συναφή με το αντικείμενο της προμήθειας.

    α) σε όλα τα στάδια που προηγήθηκαν της σύμβασης δεν ενήργησε αθέμιτα, παράνομα ή καταχρηστικά και ότι θα εξακολουθήσει να μην ενεργεί κατ` αυτόν τον τρόπο κατά το στάδιο εκτέλεσης της σύμβασης,
    
    β) ότι θα δηλώσει αμελλητί στην αναθέτουσα αρχή, από τη στιγμή που λάβει γνώση, οποιαδήποτε κατάσταση (ακόμη και ενδεχόμενη) σύγκρουσης συμφερόντων (προσωπικών, οικογενειακών, οικονομικών, πολιτικών ή άλλων κοινών συμφερόντων, συμπεριλαμβανομένων και αντικρουόμενων επαγγελματικών συμφερόντων) μεταξύ των νόμιμων ή εξουσιοδοτημένων εκπροσώπων του καθώς και υπαλλήλων ή συνεργατών τους οποίους απασχολεί στην εκτέλεση της σύμβασης (π.χ. με σύμβαση υπεργολαβίας) και μελών του προσωπικού της αναθέτουσας αρχής που εμπλέκονται καθ’ οιονδήποτε τρόπο στη διαδικασία εκτέλεσης της σύμβασης ή/και μπορούν να επηρεάσουν την έκβαση και τις αποφάσεις της αναθέτουσας αρχής περί την εκτέλεσή της, οποτεδήποτε και εάν η κατάσταση αυτή προκύψει κατά τη διάρκεια εκτέλεσης της σύμβασης .

  Η εν λόγω προθεσμία παραλαβης προσφορών επιτάσσεται από λόγους επείγουσας ανάγκης κατά τα αναφερομενα στο άρθρο 27 παρ. 3 του ν. 4412/2016 και ειδικότερα λόγω της δυσκολίας συγκέντρωσης στοιχείων για την προκήρυξη του διαγωνισμού από μεγάλο αριθμό Διευθύνσεων Δασών και Δασαρχείων, τα οποία βρίσκονται σε διαφορετικές γεωγραφικές περιοχές και της εμπλοκής μεγάλου αριθμού δεδομένων, ιδιατέρω σημαντικών για την ορθή προκήρυξη του διαγωνισμού. Περαιτέρω διότι στις περιοχές που βρίκονται οι εμπλεκόμενες Διευθύνσεις Δασών και τα Δασαρχεία της Επιθεώρησης Εφαρμογής Δασικής Πολιτικής Μακεδονίας Θράκης κατά τους ακόλουθους χειμερινούς μήνες επικρατούν ιδιαίτερα χαμηλές θερμοκρασίες, οι οποίες καθιστούν αδύνατη τη λειτουργία των εν λόγω υπηρεσιών χωρίς την άμεση και έγκαιρη προμήθεια πετρελαίου θέρμανσης, λαμβανομένου μάλιστα υπόψη ότι οι περιοχές που εξυπηρετεί η παρούσα προμήθεια καλύπτει τις ανάγκες πληγεισών περιοχών από τις πρόσφατες πυρκαγιές και πλημμύρες (βλ. την με αριθμό 12456/2023 ΥΑ,
