         Οι οικονομικοί φορείς που συμμετέχουν στη διαδικασία σύναψης της παρούσας σύμβασης απαιτείται να ασκούν εμπορική ή βιομηχανική ή βιοτεχνική δραστηριότητα συναφή με το αντικείμενο της προμήθειας.

         Οι οικονομικοί φορείς που είναι εγκατεστημένοι σε κράτος μέλος της Ευρωπαϊκής Ένωσης απαιτείται να είναι εγγεγραμμένοι σε ένα από τα επαγγελματικά ή εμπορικά μητρώα που τηρούνται στο κράτος εγκατάστασής τους ή να ικανοποιούν οποιαδήποτε άλλη απαίτηση ορίζεται στο Παράρτημα XI του Προσαρτήματος Α΄ του ν. 4412/2016.

         Στην περίπτωση οικονομικών φορέων εγκατεστημένων σε κράτος μέλους του Ευρωπαϊκού Οικονομικού Χώρου (Ε.Ο.Χ) ή σε τρίτες χώρες που προσχωρήσει στη ΣΔΣ, ή σε τρίτες χώρες που δεν εμπίπτουν στην προηγούμενη περίπτωση και έχουν συνάψει διμερείς ή πολυμερείς συμφωνίες με την Ένωση σε θέματα διαδικασιών ανάθεσης δημοσίων συμβάσεων, απαιτείται να είναι εγγεγραμμένοι σε αντίστοιχα επαγγελματικά ή εμπορικά μητρώα.

         Οι εγκατεστημένοι στην Ελλάδα οικονομικοί φορείς απαιτείται να είναι εγγεγραμμένοι στο Βιοτεχνικό ή Εμπορικό ή Βιομηχανικό Επιμελητήριο ή Επαγγελματικό Επιμελητήριο ή στο Μητρώο Κατασκευαστών Αμυντικού Υλικού.

         Όσον αφορά στην οικονομική και χρηματοοικονομική επάρκεια για την παρούσα διαδικασία σύναψης σύμβασης, οι οικονομικοί φορείς πρέπει να έχουν μέσο γενικό ετήσιο κύκλο εργασιών των τριών (3) τελευταίων διαχειριστικών χρήσεων μεγαλύτερο ή ίσο από το 30% της εκτιμώμενης αξίας των υλικών του διαγωνισμού για τα οποία υποβάλλουν προσφορά άνευ ΦΠΑ.

         Για την έγκυρη συμμετοχή στη διαδικασία σύναψης της παρούσας σύμβασης, κατατίθεται από τους συμμετέχοντες οικονομικούς φορείς (προσφέροντες), εγγυητική επιστολή συμμετοχής, υπολογιζόμενη στο 2% της εκτιμώμενης αξίας των υλικών που θα προσφερθούν, εκτός ΦΠΑ.

         Για την υπογραφή της σύμβασης απαιτείται η παροχή εγγύησης καλής εκτέλεσης, σύμφωνα με το άρθρο 302 παρ. 1 β) του ν. 4412/2016, το ύψος της οποίας ανέρχεται σε ποσοστό 4% επί της εκτιμώμενης αξίας της σύμβασης, εκτός ΦΠΑ, και κατατίθεται πριν ή κατά την υπογραφή της σύμβασης.
