         Gegenstand des Verfahrens ist der Abschluss eines Rahmenvertrages nach dem Open House-Modell die Dienstleistung der Personalüberlassung, welche als Arbeitnehmerüberlassungen nach dem AÜG erbracht werden sollen. Ziel ist es leistungsfähige Unternehmen nach einer erfolgreichen Eignungsprüfung mit einem Rahmenvertrag auszustatten, welcher zur Teilnahme am nachgelagerten Wettbewerb berechtigt. Diese Personaldienstleistungen werden als klassische Arbeitnehmerüberlassung nach dem AÜG erbracht. Mit Abschluss des Vergabeverfahrens HF3/23/001 soll ein Rahmenvertrag zur Personalüberlassung von Busfahrern via Arbeitsnehmerüberlassung für die Unternehmen der DB Regio AG für den Zeitraum vom 01.03.2024 bis zum 28.02.2026 abgeschlossen werden.

         Alle durch die erfolgreiche Teilnahme an diesem Verfahren gelisteten Lieferanten sind berechtigt am nachgelagerten Wettbewerb für Personalbedarfe im DB Konzern teilzunehmen und für einzelne Bedarfe durch den zuständigen Einkauf der DB AG für Personalüberlassungen (an die DB Zeitarbeit GmbH delegierte Warengruppe) angefragt zu werden.

         Im Bedarfsfall erfolgt eine Anfrage über eine IT-Anwendung ProFeed durch den Auftraggeber an den Auftragnehmer. Der Auftragnehmer hat die Anfrage innerhalb der angegebenen Termine bzw. Fristen unter Verwendung der vorgegebenen Formulare (Angebotsbestandteile: Kandidatinnenprofil und Preisblatt) zu beantworten, und gegebenenfalls zusätzlich geforderte Nachweise oder Unterlagen einzureichen.

         Werden die Angebote nicht im vorgegebenen Format, nicht fristgerecht oder unvollständig eingereicht, behält sich der Auftraggeber vor, das Angebot nicht zu berücksichtigen. Grundlegend für die Preisgestaltung gelten die abgegebenen Preise in der Anlage 1 Preismatrix zum Rahmenvertrag. Die Auswahl des Auftragnehmers erfolgt nach Verfügbarkeit und Wirtschaftlichkeit. Der Auftragnehmer erhält durch den Auftraggeber eine Bestellung in Textform. Anschließend wird für jede Arbeitnehmerüberlassung zwischen dem Auftragnehmer und dem Auftraggeber ein Arbeitnehmerüberlassungsvertrag nach Anlage 2 unter Bezug auf diese Rahmenvereinbarung geschlossen. Dazu übermittelt der Auftragnehmer den Arbeitnehmerüberlassungsvertrag an den Auftraggeber.
