VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die Leistungen konnten keinem anderen Auftragnehmer übertragen werden, da die Leistungsänderungen und zusätzlichen Leistungen im Bauablauf erforderlich geworden sind. Hierzu gehören Rückbauarbeiten von verdeckten Bauwerksstrukturen, die unbekannt waren und Rückbauarbeiten, die nicht vorhersehbar waren, insbesondere der Rückbau der Spundwände. Es war nicht möglich, die Spundwände zu ziehen, daher wurde der Rückbau im Rahmen der Freianlagen durchgeführt. Die zusätzlichen Leistungen an der Entwässerung sind erforderlich geworden, da nicht wie geplant an den Bestand angeschlossen werden konnte. Eine Änderung an den Betonfertigteilen ist technisch erforderlich geworden. Beim Aufnehmen des Bestandspflasters wurde festgestellt, dass die Menge, welche aus homogenem Pflaster gesichert werden kann, nicht ausreicht. Die Nachtragspositionen betreffen unterschiedliche Teilbereiche und sind nicht als Einzelgewerk ausgeführt worden. Es wäre nicht möglich gewesen, diese Leistung einzeln zu vergeben.
