Der AN ist mit der Erneuerung des Oberbaus und damit auch mit der Erneuerung der Weichen der Richtungsgruppe 4 beauftragt.

Nach Ril. 824.8120 Punkt 9 sind zwei DV-gestützte Weichenmessungen notwedig, Abnahme- und Freigabemessung. Im

Leistungsverzeichnis wurde vom AG nur eine Messung bestellt.

NT 11 - Die Weichen werden durch den AN erneuert, die Abnahme- und Freigabemessungen müssen daher auch durch ihn erfolgen.Eine Änderung des AN hätte eine Änderung der Gewährleistungsansprüche zur Folge gehabt und hätte zu erheblichenSchwierigkeiten in der weiteren Projektabwicklung geführt.
