Precise information on deadline(s) for review procedures:

Verstöße gegen Vergabevorschriften, durch die einem Bieter ein Schaden entstanden ist oder zu entstehen droht, können von den Bietern mit einem Nachprüfungsverfahren gemäß § 160 GWB bei der unter VI.4.1. genannten Vergabekammer geltend gemacht werden. Ein Nachprüfungsverfahren ist gemäß § 160 Abs.1 GWB nur auf Antrag zulässig.

Der Antrag ist jedoch insbesondere nur dann zulässig, wenn der jeweilige Bieter den jeweiligen Verstoß gegenüber der Vergabestelle rechtzeitig gerügt hat. Eine Rüge ist gemäß § 160 Absatz 3 dann nicht mehr rechtzeitig wenn:

- der jeweilige Bieter, der den Antrag stellt, den geltend gemachten Verstoß gegen Vergabevorschriften vor Einreichen des Nachprüfungsantrags erkannt hat, jedoch innerhalb von zehn (10) Tagen keine Rüge gegenüber der Vergabestelle erhoben hat,

- Verstöße, die aufgrund der Bekanntmachung erkennbar sind, nicht spätestens bis zu der in der Bekanntmachung genannten Frist zur Bewerbung gerügt worden sind,

- Verstöße gegen Vergabevorschriften, die erst in den Vergabeunterlagen erkennbar sind, nicht spätestens bis zum Ablauf der Angebotsfrist gegenüber der Vergabestelle gerügt worden sind.

Auch im Falle einer rechtzeitigen Rüge kann der Nachprüfungsantrag unzulässig sein, wenn mehr als fünfzehn (15) Kalendertagen nach Eingang der Mitteilung der Vergabestelle, einer Rüge nicht abhelfen zu wollen, vergangen sind.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Leistung ist aus technischen gründen zwingend im weiteren Bauverlauf bei der ausführenden Firma anzugliedern, da diese Leistung sowohl terminlich als auch gewerketechnisch direkt mit den bereits beauftragten Gewerkeleistungen zusmmenhängt und daher ausschließlich von der ursprünglich beuaftragten Firma erbracht werden kann.

Eine Ausschreibung dieser Leistung und ein damit verbundener möglicher Wechsel des Auftragnehmers nur für diese Leistung, ist aufgrund der dann nicht mehr ganzheitlichen Ausführung technisch nicht möglich und würde außerdem zu Verzögerungen in dem Bauablauf und somit auch zu erheblichen Mehrkosten und Stillstandszeiten der übrigen Gewerke und den monatlich steigenden Baupreis führen.
