Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Umbaumaßnahmen an der neuen Überleitstelle notwendig. Die dafür notwendigen Leistungen sind zusätzliche Leistungen, die

nicht vorgesehen waren.

Die zusätzlichen Arbeiten sind notwendig um die Maßnahmen durchführen zu können und die Strecke ansonsten nicht inBetrieb genommen werden kann. Die Baubegleitung musste durchgehend aus einer Hand erfolgen, um eine schlüssigeNachvollziehbarkeit auch hinsichtlich der Qualitäts- und Leistungserbringung der ausführenden Tätigkeiten Dritter sicherzustellen.Außerdem würde aus der Vergabe an einen weiteren AN die Zuordnung von Mängeln und Vertragsabweichunge immenserschwert werden.
