Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Gegenstand der Vetragsabweichung ist die Umplanung der EWHA Verteilung und des Leistungsschalters. Gemäß der Weisung 954.9101-FuW-102 besteht seit dem 06.04.2023 die Anforderung, bei Neuanlagen Leistungsschalter als Eingangssicherung im HV der EWHA zu verwenden. Zuvor waren NH-Sicherungen vorgesehen. Um diesen Vorgaben gerecht zu werden, ist es erforderlich, die aktuelle Ausführungsplanung hinsichtlich der Änderungen zu überarbeiten.Der Auftragsnehmer ist bereits mit der Ausführungsplanung der EEA/ 50Hz Anlagen beauftragt. Das Einbinden eines neuen Auftragnehmers zur Umplanung der EWHA Verteilungen und des Leistungsschalters führt zu Mehrkosten, da in diesem Falle die Planung neu beauftragt werden müsste. Der Auftragnehmer plant bereits die EEA-Anlagen. Die Umplanung dient hier lediglich dazu, dass die Herstellung der Anlagen regelwerkskonform erfolgen kann.
