Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist

fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2

GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der

Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist

kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nachtrag 65: Die Videoplanung der B-Ebene wurde auf Grundlage der EP und der Quast Ende 2021 fertiggestellt und abgegeben. Auf Grund

von geänderten Anforderungen (2022) an die Videoasustattung durch die Budespolizei ist die Planung an diese anzupassen

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Eine Vergabe an eine zusätzlichen Planer ist unwirtschaftlich, da eine erneute Grundlagenermittlung erfolgen müsste. Diesnimmt Zeit und somit auch Geld in Anspruch. Der aktuell im Projekt gebundene Planer kann auf die Erfahrungen und Grundlagenaus der bisherigen Planungsleistung zurückgreifen.Ein Wechsel würde die Leistungsbetreung und Mängelansprüche gegenüber dem AN sehr erschweren. Wie bereits zuvorbeschrieben führt ein Wechsel zu einem zeitlichen Verzug der Gesamtplanung und zu nicht unerheblichen zusätzlichen Kosten fürdie zusätzlichen Leistungen, die ein weitere Planer für die Einarbeitung/Grundlagenermittlung benötigt.
