Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist

fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2

GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der

Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist

kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der Hauptvertrag mit dem AN umfasst ausschließlich den PfA 9.0 bis Bahn-km 241,6+16. Bereits im Jahr 2016 wurde seitensder Projektleitung festgestellt, dass der Übergangsbereich zwischen den PfA 9.0 und 9.1 bislang nicht berücksichtigt wurde undeine EP (Lph. 3) zur Auflösung des als Zwischenzustand hergestellten Abzweigs Schliengen-Nord zur Durchbindung der 4-Gleisigkeit der Abschnitte 9.0 und 9.1 erforderlich war (siehe NT 16-04).Im Projektverlauf kam es seitdem zu verschiedenen Änderungen, die zusätzliche Leistungen erforderlich gemacht haben. Diesehaben sich mit fortschreitenden Abstimmungen stetig entwickelt, weswegen mehrere Anordnungen erforderlich waren. DieLeistungen zur Aktualisierung der Kostenpläne sowie zur Erstellung der Ausschreibungsunterlagen und Wertung derAngebotsunterlagen wurden mit Schreiben vom 26.10.2021 und 10.02.2022 angeordnet. Ferner wurde im Rahmen der 95.Planungsbesprechung am 19.01.2022 der AN angewiesen, den Antrag zur 15. Planänderung zu prüfen.
