Wir weisen darauf hin, dass die VO (EU) 2022/576 zur Änderung der VO (EU) Nr. 833/2014 Anwendung

findet und Unternehmen, die den Sanktionsmaßnahmen in Art. 5k der VO (EU) 2022/576 unterfallen, aus dem

Vergabeverfahren ausgeschlossen werden.

Ab dem 19.04.2017 ist bei Vergaben gemäß SektVO sowie größer 50.000 Euro nur noch die Übermittlung von

Angeboten/Teilnahmeanträgen über das Vergabeportal der Deutschen Bahn AG zulässig.

Durch den Wirtschaftsteilnehmer sind als Teilnahmebedingung neben den unter III.1.1 bis III.1.3 genannten

Erklärungen/Nachweisen folgende weitere Erklärungen/Nachweise erforderlich:

Erklärung, ob und in wieweit wir mit dem/den unten genannten weiteren vom AG für dieses Projekt beauftragten

Unternehmen verbunden (gesellschaftsrechtlich verbunden im Sinne § 18 AktG / verwandtschaftlich) oder

wirtschaftlich abhängig sind. Bei Bietergemeinschaften gilt diese Verpflichtung bezogen auf jedes einzelne

Gemeinschaftsmitglied.

Der Auftraggeber behält sich vor, Angebote von Bietern auszuschließen, die unter Mitwirkung eines

vom Auftraggeber beauftragten Ingenieurbüros erstellt wurden. Gleiches gilt, wenn zwischen Bieter und

beauftragtem Ingenieurbüro eine gesellschaftsrechtliche/verwandtschaftliche Verbundenheit oder wirtschaftliche

Abhängigkeit besteht.

Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.
