Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Leistungen waren im Detail aus nachfolgenden Gründen erforderlich:Anpassung der PT1-Planung zur Umsetzung Lückenschluss für die Weiche 6Die Weiche 6 befand sich unter dem Signalausleger ZU3/ZU4 genau im Zungenbereich. Es war ursprünglich geplant, die Weiche6 zunächst stillzulegen und diese erst nach der Inbetriebnahme des neuen ESTW auszubauen. Bei der Erstellung der AP PT1wurde festgestellt, dass die Achszähler und PZB-Magneten im Weichenbereich nicht einbaubar sind. Daher war es erforderlich,die Weiche bereits im Vorfeld zurückzubauen und entsprechend umzuplanen, um den Lückenschluss zu realisieren. Für dieseÄnderung musste die PT1-Planung des ESTW-A RML angepasst werden.Mehrere Anpassungen der PT1-Planung für die Bauphase 5 am Bf Müllheim- Wegen der zukünftigen Speiseleitung musste der Ausleger auf bahnlinks umgeplant werden. In der EP wurde derSignalausleger bahnrechts vorgesehen. In der EP war es aufgrund des fehlenden Detaillierungsgrades dieser Leistungsphasenicht
