Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. 38 - Mehraufwand bei der Oberleitung:

- Zusätzliche Baustellenlogistik infolge der Sperrpausen, welche zum Einbau von Speiseleitungen erforderlich sind,

- Herstellen der Kabelwege zur Erdung im Handbereich inklusive der sachgerechten Anbringung der Pflastersteine

- Fertigstellung der Kabelverlegung zu Mast 11 infolge der fehlenden Unterquerung eines Gleises zur NEA vom Masten 10-10b durch die Kabeltiefbaufirma

- Ein-/ oder Ausbau einer Bahnerdungsvorrichtung auf der Arbeitsstelle in Abstimmung mit der Bauüberwachnung für andere

Gewerke.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Eine Ausschreibung und Neuvergabe dieser Leistung hätte zur Folge, dass die vertraglich festgelegten Termine nicht gehalten werden könnten, die wiederum zu Verzögerungen bei den anderen beteiligten Gewerken führen könnte. Mit der Vergabe der Leistung an den Hauptunternehmer kann die Terminschiene vsl. gehalten werden. Andernfalls resultieren weitere Mehrkosten. Durch Neuauschreibung der zusätzlichen Leistung ist der Fertigstellungstermin gefährdet. Zusätzliche Schnittstelle zwischen zwei Auftragnehmern erfordern zusätzliche Koordinierungsleistungen.
