Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Für Schulungen an der DSTW-Schulungs-Anlage des Herstellers Thales wurde ein PZB-Prüfkoffer angeschaft. Da nach wie vor Schulungsbetrieb statt findet, allerdings mittlerweile die Software des geräts veraltet ist, muss diese erneuert werden.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Ursprünglich sollten die Vorgänge rund um die Schulungen und die Schulungsanlage abgeschlossen sein. Durch Verzögerungen ist dies nicht der fall, so dass dieser Nachtrag nun notwendig wird.
