Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist

GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die nachfolgend aufgeführten zusätzlichen Leistungen waren zwingend erforderlich, um die erforderlichen Bauleistungen fürdie Ausschreibung zu definieren und die Einhaltung der Terminschiene zur Ausführung, insbesondere der Sperrpausen, zugewährleisten. Die Leistungen waren im Detail aus nachfolgenden Gründen erforderlich, um den Werkerfolg gewährleisten zukönnen:Ergänzung der Speiseleitung für den PfA 8.4 im Ausschreibungspaket PfA 9.0Die Speiseleitung für die Energieversorgung des PfA 8.4 (Abschnitt Bad Krozingen–Müllheim), der sich aktuell noch imPlanfeststellungsverfahren befindet, wird über das Unterwerk Müllheim sichergestellt. Das Unterwerk Müllheim steht im PfA 9.0.Aufgrund der baubetrieblichen Belange wurde die Entscheidung getroffen, die für den Betrieb des PfA 8.4 erforderlicheSpeiseleitung schon mit der Realisierung der OLA für die Neubaustrecke (NBS) im PfA 9.0 aufzubauen. Mit dieserVorabmaßnahme werden Kosten gespart und die betrieblichen Einschränkungen der NBS i
