Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist

GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Schlussrechnungen der zuständigen Baufirmen für die bauliche Realisierung der SÜ Kleinfeldele und SÜ Fischerpfadliegen vor. Gemäß Punkt 3.14 der Anlage 01.2 Objektplanung Ingenieurbauwerke des Hauptvertrages mit dem AN sind imRahmen der beauftragten Leistungsphase 3 die Ablöseberechnungen gemäß "Richtlinien und Erläuterungen zu den Richtlinienfür die Berechnung der Ablösungsbeträge der Erhaltungskosten für Brücken und sonstige Ingenieurbauwerke -Ablösungsrichtlinien 1980” aufzustellen. Diese wurden bereits 2010 durch die Einführung der Ablösungsbeträge-Berechnungsverordnung - ABBV ersetzt. Mit dem Neunten Gesetz zur Änderung des Bundesfernstraßengesetzes und zurÄnderung weiterer Vorschriften vom 31.05.2021 wurde die ABBV zur Berechnung von Ablösungsbeträgen nach demEisenbahnkreuzungsgesetz, dem Bundesfernstraßengesetz und dem Bundeswasserstraßengesetz nochmals geändert. DieÄnderungen sind am 01.07.2021 in Kraft getreten.Aufgrund des Ersetzens der Ablösungsrichtlinien durch
