Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Rahmen der Ausführung der Kabelschächte im Bereich der Betonschalthäuser der elektrischen Weichenheizanlagen W1,W2 und W3 in Langenfeld ist es erforderlich, die Kabelschächte auf Abstand zu den Betonschalthäusern herzustellen und miteinander zu verbinden.Im Rahmen der Ausführung der Kabelschächte ist es erforderlich, die Kabelschächte auf Abstand zu den Betonschalthäusern herzustellen. Die Ausführung ist mittels Betonfundamente als Abstandhalter und Randsteinen zur Anfüllung zu betonieren. Urpsung der Anforderung ist, dass ein Ordnunggemäßes öffnen der Kabelschachtdeckels nicht möglich ist weil die Kabelzangenöse zu nah am BSH sind.
