Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Trotz planmäßig erfolgter Programmierung des Zugnummerndekoders (ZND) für den Bereich Langenfeld wurde die beabsichtigte Funktion nicht erreicht. Eine manuelle Konfiguration des ZND ist daher notwendig geworden.Der AN ist gemäß Hauptvertrags-LV umfänglich mit den elektrotechnischen Arbeiten an der Leit- und Signaltechnik (LST) bzw. der ZN-Anlage beauftragt. Die zusätzlich zu erbringenden Leistungen können dabei von der Erbringung der sonstigen Vertragsleistungen kaum getrennt werden. Die Vergabe dieser Leistungen an ein weiteres Unternehmen ist aus terminlichen, sowie wirtschaftlichen Gründen nicht sinnvoll.
