Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist

MKA 027 - Teilprojekt 3 - Zusätzliche Objekte vorgesetzte Bauwerke, Signalausleger, Kabeltiefbau, Regenrückhaltebecken, Ingenieurbauwerke, Anprallschutz, Berührungsschutz - Anschreiben

Art und Umfang der Änderungen (mit Angabe möglicher früherer Vertragsänderungen):

Die Änderungen umfassen die Fortschreibung von zusätzlichen Objekten (für vorgesetzte Bauwerke, Signalausleger,

Kabeltiefbau, Regenrückhaltebecken, Ingenieurbauwerke sowie dem Anprall- und Berührungsschutz) im Rahmen der Vorplanung

gemäß Planungsfortschritt, welche in der ursprünglichen HOAI Objektliste als auch den bisherigen Fortschreibungen der

Nachträge 19 und 32 nicht enthalten waren. Darüber hinaus werden weitere Objekte aufgezeigt, für die aufgrund der aktuellen

Planungstiefe noch keine Kosten ermittelt wurden.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die Änderungen ergeben sich zum einen aus der Erweiterung der Infrastruktur zwischen Langwedel und Bremen-Sebaldsbrück gemäß VAst und EBWU zum anderen aus der Berücksichtigung des Deutschlandtaktes in der Vorplanung.Hieraus ergeben sich notwendige Anpassungen an den vorhandenen Anlagen und Bauwerken der Strecke sowie zusätzlicheAnlagen und Bauwerke, die über das Leistungssoll des ursprünglich zu Grunde liegenden Vertrages hinausgehen und zumZeitpunkt der Ausschreibung unmöglich vorausgesehen werden konnten. Die Anzahl und die Zusammenstellung der Objekteergeben sich erst mit dem Fortschritt der Vorplanung. Z.B. konnte erst mit der Schalltechnischen Voruntersuchung die Anzahlund Lage der Schallschutzwände ermittelt werden, welche wiederum Einfluss auf die vor die EÜ zu errichtenden vorgesetztenBauwerke haben. Originäre Planungsleistungen werden nicht durch andersartige Leistungen verändert womit derPlanungsinhalt und der Gesamtcharakter des Auftrags unverändert bleiben.
