Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Bei der Nachweisführung des Bodens wurde festgestellt, dass eine sehr ungleichmäßige Verdichtung in den Feldern 1, 2, 3 und 4 vorliegt. Der Bodenaustausch von ca. 50 cm inklusive lagenweiser Verdichtung in Feld 5 ist das Ergebnis der Prüfung der Mächtigkeit der tragfähigen Schicht. Der Zustand des Baugrundes war uns zu diesem Zeitpunkt nicht bekannt. Die zusätzlichen Leistungen sind zur Herstellung der Sauberkeitsschicht für den Anprallschutz und somit zur Erbringung einer Leistung des Hauptvertrags notwendig. Nach Erfüllung dieser Bedingungen darf die Sauberkeitsschicht hergestellt werden.
