The works, supplies or services can be provided only by a particular economic operator for the following reason:
- absence of competition for technical reasons

Explanation:

Eine Vergabe des Auftrags an diesen Wirtschaftsteilnehmer zur Beschaffung eines robotergestützten, minimalinvasiven Chirurgie-Systems ist gem. § 14 Abs. 4 Nr. 2b VgV gerechtfertigt, da die vielfältigen Anforderungskriterien der Klinik an das System nur vom benannten Auftragnehmer erbracht werden können. Das System des Wirtschaftsteilnehmers ist das einzige seiner Art, vom dem die geforderten Kriterien hinsichtlich, Zertifizierung, Instrumentenportfolio, energiebasierter Instrumente, Sicherheitsmechanismen, Bildgebung, Fluoreszenzangiographie, Platzbedarf und Ausführung der Systemumgebung erfüllt werden.

Zudem ist in der Einrichtung des Auftraggebers bereits ein System des Wirtschaftsteilnehmers - jedoch in vorheriger Modellgeneration - vorhanden. Alle signifikanten Anwender in der Einrichtung des Auftraggebers sind mit dem vorliegenden Bedienkonzept eingehend vertraut - daher wäre ein Wechsel des Systems (auch im Sinne der Patientensicherheit) ein schwerwiegender Nachteil für den Auftraggeber.
