Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Anordnung BÜW des Rückbaus der Bestandsbrücke

Bauüberwachung des Rückbaus der Bestandsbrücke:

Der AN soll die Bauüberwachung für den Rückbau der Bestandsbrücke übernehmen. Er ist bereits mit der Bauüberwachung des gesamten Neubaus der neuen Brücke beauftragt.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der Rückbau der Bestandsbrücke wird zusammen mit dem Los 2 (Über-, Oberbau) der Hauptbaumaßnahme ausgeschrieben. Der AN ist bereits mit der Bauüberwachung des Los 2 beauftragt. Synergien im Leistungsablaufs gehen bei Beauftragung Dritter verloren und sind vertragsrechtl. mit Schwierigkeiten belegt (2 Bauüberwachungen für einen AN-Bau). Parallel zu den Neubauarbeiten fanden div. Arbeiten an der Bestandsbrücke statt, in die der AN tw. involviert war. Die Beauftragung eines weiteren AN bedeutet einen erhebl. Verlust an Wissen und Erfahrungen auf der Baustelle. Außerdem findet der Rückbau der Bestandsbrücke parallel zum Neubau statt, sodass es zu Schwierigkeiten beim Ineinandergreifen verschiedener Leistungen, insbesondere hinsichtlich des Leistungsablaufs kommen kann. Diese sind auf der Baustelle gesamtheitlich zu koordinieren. Der AN kennt die Örtlichkeit mit ihren Randbedingungen vollumfänglich und ist bereits seit mehreren Jahren täglich vor Ort
