Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Im Zuge einer Baufeldbegehung im Bahnhof Mülheim(Ruhr)-Styrum gemeinsam mit Auftragnehmer und Auftraggeber ist man zu

der Erkenntnis gekommen, dass eine Rammgründung für den Mast 0-8gN aufgrund der Nähe zur Bestandsanlage BAB40 und

den darauf entstehenden Vibrationen durch Rammen, Schäden am Fundament der Brücke/Widerlager entstehen könnten.

Daraufhin wurde gemeinsam abgestimmt, eine Bohrgründung herzustellen.

Die Bohrgründung ist nicht Bestandteil des HLV und ist somit als zusätzliche Leistung gemäß § 2 Abs. 6 Nr. 1 VOB/B

einzuordnen. Diese Gründung wurde aufgrund der damals fehlenden Kampfmittelfreigabe während der Totalsperrpause Ostern

2023 hergestellt.

Für den Maststandort 0-5dN ist laut des HLV eine Gründung durch Ramme herzustellen. Ähnlich, wie auch beim Maststandort 0-

8gN, fand die Herstellung der Gründung des Maststandortes während der Totalsperrpause Ostern 2023 aufgrund der damals

fehlenden Kampfmittelfreigabe statt. Um hier die entstehenden Transportkosten unterschiedlicher Gerätschaften (d.Red Bohrgerät

und Ramme) einzusparen, haben sich Bau AN und Projektleitung darauf geeinigt, die Gründung entgegen der beauftragten

Leistung gemäß HLV herzustellen.

Bauliche Freiheiten / Gegebenheiten vor Ort können trotz Sorgfalt des AG nicht in Gänze vorhergesehen werden.
