Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Trotz umfangreicher Erkundungsmaßnahmen bezüglich des Baugrunds ist es zu Setzungen an den Winkelstützwänden des Bahnsteigs 1 gekommen. Die daraus resultierende Schiefstellung muss sarniert werden.
