Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die Starkregenereignisse im Juli 2021 hatten zur Folge, dass die bereits fertiggestellte Böschung an Gleis 113 in den Bereichen km 66,88 und km 66,0 punktuell beschädigt worden ist. Vor diesem Hintergrund mussten in diesen Bereichen die Profilierung der Tragschicht als auch die Profilierung mit belebter Bodenschicht zwingend vor der Inbetriebnahme im Juli 2023 überarbeitet werden. Diese zusätzliche Leistung ist auf ein unerwartetes Ereignis ausgelöst durch höhere Gewalt zurückzuführen und konnte im Hauptvertrag nicht berücksichtigt werden.
