Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Rahmen der Aufstellung der Ausführungsplanung wurde verschiedene Änderungen an den herzustellenden Betonkabelkanälen geändert. Dies bedingt einen Mehrvergütungsanspruch für folgende Leistungen: Geänderte Dimensionierung des Betonkabelkanals im Bereich EÜ Rathenaustraße, Zusätzliche Herstellung eines Betonkabelkanals an der Stützwand III, Herstellung eines Absenkbauwerks an der FU Rathenaustraße zur Anbindung des Kabelkanals der Stützwand IV, Entfall diverser Absenkbausätze.Die zusätzlichen Leistungen sind technisch eng verzahnt mit den hauptvertraglich geschudeten Leistungen und können daher nicht als separate Leistung vergeben werden. Eine Trennung dieser geänderten Leistungen von der vertraglich vereinbarten Leistung wäre mit erheblichen Zusatzkosten (Ausschreibung, Einweisung neuer AN, Abstimmung der Logistik) sowie bauzeitlichen Verzögerungen verbunden, die hier nicht zu rechtfertigen sind.
