Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Nach Erstellung der Ausführungsstatik wurde festgestellt, dass die hauptvertraglich vorgesehenen Lagerkräfte an den Überbauten der EÜ Rathenaustraße überschritten werden. Hieraus ergeben sich Än-derungen an den Lagern. Zudem war es notwendig, an den montierten Lagern Nullmessungen durchzuführen, was hauptvertraglich nicht berücksichtigt wurde.Die Erstellung der Lager für die EÜ Rathenaustraße sowie die Aufstellung deren Ausführungsplanung sind hauptvertraglich geschuldet. Durch die geänderten Lagerkräfte verändert sich der Gesamtcharakter des Auftrages nicht. Insbesondere vor dem Hintergrund der Baustellenlogistik und der Einhaltung der Vertragstermine ist eine Neuvergabe der Leistungen unwirtschaftlich. Eine Trennung dieser geänderten Leistungen von der vertraglich vereinbarten Leistung wäre mit erheblichen Zusatzkosten (Ausschreibung, Einweisung neuer AN, Abstimmung der Logistik) sowie bauzeitlichen Verzögerungen verbunden, die hier nicht zu rechtfertigen sind.
