Wenn der Zuschlag bereits wirksam erteilt worden ist, kann dieser nicht mehr vor der Vergabekammer angegriffen werden (§168 Abs.2 , S1 GWB)

Die Zuschlagserteilung ist möglich, 10 Kalendertage nach Absendung der Bekanntgabe der Vergabeentscheidung per Fax oder Email, bzw. 15 Kalendertage nach Absendung der Bekanntgabe der Vergabeentscheidung per Post. (§134 Abs. 2 GWB)

VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

LÄA 144-43 Erstellung eines Maßnahmenkonzepts zum Schutz gegen Starkregenereignisse und finale Bewertung sowie Überarbeitung/Anpassung mit Hilfe iterativer Berechnungsvorgänge des bestehenden Starkregen-Modells.

Es handelt sich um eine Aktualisierung einer für den werkvertraglichen Erfolg des Hauptvertrages (B0171400 und Fortschreibung NA 144-7 im PfA 8.3) unentbehrliche Leistung.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

.Da die Tieflage ein sehr sensibles Bauwerk gegenüber eindringendem Oberflächenwasser darstellt, wurden im Rahmen der technischen Planung der Tieflage der NBS Karlsruhe–Basel im PfA 8.3 & 8.4 die Gefahren ausgehend von Starkregenereignissen auf Grundlage eines hydraulischen Modells bewertet. Im Ergebnis wurde die Betroffenheit der Tieflage durch Starkregenereignisse festgestellt, weshalb die Zulassungsfähigkeit und somit der erfolgreiche Projektabschluss ohne passendes Maßnahmen- bzw. Schutzkonzept infrage gestellt werden muss
