Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

NT 66 Umweltbaubegleitung für die Baugrunduntersuchung

Ausgangspunkt des Nachtrags sind die Einbringung von unterschiedlichen technischen Varianten von Einzelbauwerken PFA

übergreifend. Im Zuge der Variantenbetrachtung sind Baugrunduntersuchungen durchzuführen, die hinsichtlich der

Umweltbelange vorab zu bewerten und während der Untersuchungen zu begleiten waren. Durch die Umweltbaubegleitung sind u.

a. Projektgespräche mit den Beteiligten durchzuführen, die Umweltauswirkung auf Basis des Untersuchungsumfanges zu

bewerten, den Antrag auf Freigabe bei der UNB zu stellen sowie die eigentlichen Untersuchungen vor Ort zu begleiten.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Bearbeitung ist plausibel im Angebot für Nachtragsleistungen dokumentiert. Die bisher erarbeitete Grundlagenermittlungdurch den AN innerhalb der PFA ist Bestandteil der Umweltbegleitung der Baugrunduntersuchungen. Die Vergabe an einenneuen AN hätte für die Einarbeitung zusätzliche Kosten generiert. Hieraus ergeben sich nutzbare Synergien. Bei einem Wechseldes AN würden diese Synergieeffekte verloren gehen. Ein Wechsel des AN ist insofern aus wirtschaftlichen Gründen nicht zubefürworten. Ein Wechsel des AN würde zu einer erheblichen Terminverzögerung führen. Das bereits beim AN erworbeneFachwissen wird für die Erbringung der zusätzlichen Leistungen zwingend benötigt. Das berechnete Honorar für zusätzlicheLeistung ist angemessen und entspricht der erwarteten Größenordnung.
