Nature and extent of the modifications (with indication of possible earlier changes to the contract):

14 - Nachtschichtarbeit Steilstrecke: Parallele Arbeiten im Zeitraum vom 10.08.20 – 05.09.20. Die Arbeiten wurden in der Nachtschicht ausgeführt. Dies führte aufgrund von Lohnzulagen und dem Produktivitätsverlust bei Nachtarbeiten zu erhöhten Personal- und

Gerätekosten. Die reduzierte Leistung bewirkte wiederum, dass die Arbeiten nicht in der Totalsperre abgeschlossen werden konnten. Die Arbeiten mussten daher parallel zu den Oberleitungsarbeiten im Zeitraum vom 07.09. – 30.09.20 fertiggestellt werden.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Im Zuge der VOB Abnahme wurden auf der Strecke diverse Zusatzarbeiten angeordnet: Die Anordnung für die Durchführungder Arbeiten in der Nachtschicht erfolgte durch Herrn Brand im Email vom 09.07.2020. Anspruchsgrund waren:Anlage_4_02_02_Anordnung der LeistungsänderungenDie zusätzlichen Aufwendungen bei den KTB-Arbeiten ergeben sich aufgrund parallel zu den Kabeltiefbauarbeitenausgeführter Arbeiten für die Erstellung der Oberleitung: Die Durchführung der KTB-Arbeiten war grundsätzlich unter Tagskalkuliert (siehe Anlage_7_3.25_Maßnahmen-und-Sperrpausendarstellung). Aus den Ausschreibungsunterlagen wargrundsätzlich bekannt, dass parallel Oberleitungsarbeiten ausgeführt werden. Ein paralleles Arbeiten war aber aufgrund derder Logistik der Oberleitungsarbeiten großteilsnicht möglich, da durch die Oberleitungsfirma immer der gesamtenSteilstreckenbereich besetzt wurde und nicht festgelegt werden konnte, in welchem in welchem Bereich parallelKabeltiefbauarbeiten ausgeführt werden.
