IV.1.1)Type of procedure

The works, supplies or services can be provided only by a particular economic operator for the following reason:
- absence of competition for technical reasons

Explanation:

Für den Messeinsatz werden bei der Bayer. Polizei ausschließlich sog. standardisierte Messverfahren i.S.d. Beschlüsse des BGH (BGHSt 39, 291 und BGHSt 43,277) verwendet, welche amtlich, d.h. von der Physikalisch-Technischen Bundesanstalt (PTB), zugelassen sein müssen. Die Zulassung der PTB entfaltet rechtlich die Wirkung eines Behördengutachtens (antizipiertes Sachverständigengutachten). Sie indiziert, dass bei dem jeweils zugelassenen Gerät ein durch Normen vereinheitlichtes (technisches) Verfahren vorliegt, bei dem die Bedingungen seiner Anwendbarkeit und sein Ablauf so festgelegt sind, dass unter gleichen Voraussetzungen gleiche Ergebnisse zu erwarten sind. Dementsprechend gilt dann für das Gericht, dass eine nähere Überprüfung nur geboten ist, wenn im konkreten Fall Anhaltspunkte für eine Fehlmessung gegeben sind.

Gemäß Bestätigung der PTB ist die kombinierte Rotlicht-Geschwindigkeitsmessanlage vom Typ POLISCAN FM1 der Fa. Vitronic ist derzeit die einzige dort zugelassene digitale, auf dem Markt verfügbare Rotlicht- und Geschwindigkeitsmessanlage ohne Schleifentechnik und hat somit eine Monopolstellung inne. Da kein alternatives kombiniertes Rotlicht-Geschwindigkeitsmessgerät mit PTB-Zulassung auf dem Markt verfügbar ist, besteht aus technischen Gründen kein Wettbewerb (§ 14 Abs. 4 Nr. 2 Buchst. b VgV).

Die Voraussetzungen des § 14 Abs. 4 Nr. 2 Buchst. b VgV gelten auch uneingeschränkt, da es keine alternativen Produkte oder Ersatzlösungen auf dem Markt gibt; der mangelnde Wettbewerb wird zudem nicht durch den Auftraggeber und die durch ihn definierten Eigenschaften hervorgerufen, sondern durch die o.g. Gesetzeslage bzw. die höchstrichterlichen Entscheidungen (vgl. § 14 Abs. 6 VgV).
