Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. NT 65 Erweiterung der Sichtachsenstudie zu den geplanten Lärmschutzwänden des Vorhabens PFA Lübeck

Die Hansestadt Lübeck als maßgebliche Kommune für den PFA Lübeck hat im Zuge des frühen Austausches zur Sichtachsenbetrachtung auf das UNESCO-Weltkulturerbe auf die Altstadt noch weitere ergänzenden Forderungen aufgestellt hat. Diese beinhalteten u.a. anhand von insgesamt drei Stellungnahmen seitens der Stadt sowie Gespräche Detailuntersuchungen zur Katharinenstraße (Pufferzone des Weltkulturerbes). Dazu gehörten auch Öffentlichkeitstermine zur Vorstellung der Sichtachsenstudie und entsprechende notwendige Vorbereitungen wie Erstellung einer Präsentation. Darüber hinaus hat sich geringfügig die technische Planung geändert, weshalb auch hier eine Aktualisierung ur Konsistenz der Planfeststellungsunterlage erfolgen musste.

Die Bearbeitung ist plausibel im Angebot für Nachtragsleistungen dokumentiert. Bei der Bearbeitung mit dem gleichen AN können bereits vorliegende Erkenntnisse und vorhandene Grundlagendaten weiter verwendet und genutzt werden. Hieraus ergeben sich nutzbare Synergien.
