Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Es liegt derzeit eine Machbarkeitsstudie (MBS) zur zukünftigen betrieblichen Situation im Bereich HH-Hbf bis HH-Harburg vor. Die MBS war dem AG zum Zeitpunkt der Beauftragung nicht bekannt. Die aktuellen Erkenntnisse des Betriebes sind Anlass für die Entscheidung der Betrachtung einer zusätzlichen Variante zur Erneuerung vom KrBw Peute. Ziel ist die Optimierung der betrieblichen Gesamtsituation im Bereich der Elbinsel. Da es hierdurch zu Umtrassierungen aller Fernbahngleise und zu weiteren Flächeninanspruchnahmen kommt, ist die Planung einer weiteren Variante in Vorplanungstiefe erforderlich. Das bestehende Vorplanungsheft wird um die zusätzliche Variante erweitert. Diese Leistung ist nicht im aktuellen Vertrag mit dem AN aufgeführt und daher ist ein zusätzlicher Auftrag erforderlich.
