Im Zuge der Erarbeitung der LP 3 wurde eine hohe Abweichung der vorhandenen Plangrundlagen zum realen Bautenstand festgestellt. Dadurch werden anteilig Wiederholungsleistungen der LP 1+2 erforderlich. Dies war zum Beauftragungszeitpunkt nicht absehbar und führt dazu, dass bereits erbrachte Leistungen wiederholt werden müssen. (Nachtrag 1, 2022)

Des weiteren zeichnete sich im weiteren Projektfortschritt ab, dass sich eine Löschanlage in der tatsächlichen vorhandenen Bestandssituation nicht wirtschaftlich einbauen und betreiben lässt. Daher wurde auch das bisherige Brandschutzkonzept hinsichtlich Optimierungs- und Kosteneinsparungspotential erneut überprüft, mit dem Ergebnis, dass ein neues Brandschutzkonzept mit einer wirtschaftlicheren Lösung zu erarbeiten ist. Aufgrund seiner Befähigung und der vorhandenen Erfahrung mit dem Bestand, wird die Erstellung des neuen Brandschutzkonzepts vom Objektplaner ergänzend zum Hauptauftrag übernommen (Nachtrag 2, 2023).

- Bestandsbegehungen zur Ermittlung des tatsächlichen Bautenstands (anteilige Wiederholung LP 1+2) (Nachtrag 1)

- Erstellung eines neuen Brandschutzkonzeptes, nachdem sich das bisherige im Zuge der Fortschreibung der Planung als unwirtschaftlich und schwer realisierbar herausgestellt hat (erforderliche Erweiterung Planungsumfang LP 3) (Nachtrag 2).

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Notwendigkeit der Änderung aufgrund von Umständen, die ein öffentlicher Auftraggeber bei aller Umsicht nicht vorhersehen konnte.Die Änderung des Auftrags ist ohne Durchführung eines neuen Vergabeverfahrens nach §132 Abs. 2 S.1 Nr. 2 und Nr. 3 GWB zulässig. Die Beauftragung eines anderen Auftragnehmers ist aus wirtschaftlichen Gründen nicht möglich und würde zu einem deutlich erhöhten Koordinierung-/Anpassungsaufwand führen. Außerdem würde die Beauftragung eines weiteren Auftragnehmers zu Unklarheiten bei der Mangelhaftung sowie zu massiven Verzögerungen und erheblichen Mehrkosten führen, die in keinem angemessenen Verhältnis zum Wert der Zusatzleistung stehen.
