Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Nachtrag 17, DB E&C, Kartierung

Nach der Festlegung des zusätzlichen Flächenbedarfs an Untersuchungsgebieten (liegt aktuell bei 7,22 ha) ergibt sich, dass in

den einzelnen Untersuchungsgebieten ergänzende Kartierungen zu verschiedenen Artengruppen (Amphibien, Reptilien,

Fledermäuse, Brutvögel, Biotoptypenkartierung) durchgeführt werden müssen.

Alle Untersuchungsergebnisse werden im Kartierungsbericht ausgewertet, dokumentiert und dargestellt.

Gleichzeitig ruft der vergrößerte Kartierungsumfang

einen erhöhten Bedarf an Auswertung und Dokumentation der erhobenen Daten hervor

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die DB E&C ist innerhalb der Leistungsphasen 3/4 mit der Erstellung eines Fachbeitrages zum Artenschutz beauftragt,innerhalb welchen Kartierungen zu erfolgen haben. Innerhalb der Planung hat sich herausgestellt, dass die dafür zu betrachtendeFläche weitaus größer ausfällt, als in der Ausschreibung angegeben. Im Rahmen der Beauftragung hat sich die DB E&C bereitsmit der Örtlichkeit und dem Genehmigungsverfahren (Seitens Behörden) vertraut gemacht und sich auch mit der zuständigenNaturschutzbehörde (BUKEA) über Art und Umfang der erforderlichen Kartierungen abgestimmt. Das bereits erworbene Wissenüber die verschiedenen Genehmigungsverfahren kann von DB E&C effektiv genutzt werden, um die Leistung (Umweltkartierung)effizient zu erbringen. Bei einem Wechsel des AN würde dieser Vorteil verloren gehen. Zudem ist die DB E&C mit der Art derLeistung beauftragt. Es vergrößert sich lediglich deren Umfang.
