Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. NT12 Zusätzlich erforderliche Leistungen: teilprojektübergreifende Abstimmungen, Fortschreibung

Entscheidungsmatrix, Anpassung der schalltechnischen Lagepläne nach Fertigstellung VP-Heft,

Anfertigung von Isophonen der Variante 201

Gegenstand des Vertrags sind die Planungsleistungen der Gewerke KIB, VA, Ausrüstungstechnik,

Geologie, Schall & Erschütterung sowie Umwelt in o.g. Projekt.

Für die Überarbeitung der Bewertungsmatrix (Neuverschneidung Schutzgebietsflächen) der Varianten

V11 TR1, V11TR2, V16.1 und V20.1 waren nach Abschluss der Qualitätssicherung und Gleichstellung

Anpassungen nach Vorgaben des AG erforderlich. Des Weiteren waren Pläne der Schalltechnischen

Untersuchungen der Variante V20.1 anzupassen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Leistungen sind aufgrund der inhaltlichen und terminlichen Zusammenhänge nur sinnvoll durch denbeauftragten AN zu erbringen. Dieser hat bereits die Planungsleistungen im Teilprojekt für alle zubeplanenden Varianten erbracht.Ein Auftragnehmerwechsel hätte einen hohen kontinuierlichen Abstimmungsbedarf mit dem beauftragtenAN zur Folge gehabt und daraus folgend hohe Zusatzkosten verursacht. Des Weiteren wäre bei einerNeuausschreibung der vorgesehene Termin für die Erstellung der Unterlagen nicht einzuhalten gewesen.Für die Überarbeitung der Unterlagen hat der AN den NT12 eingereicht. Dem Nachtrag wird dem Grundenach zugestimmt.
