Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Nachtrag 18: Grundlagenermittlung Bahnstrom, DB E&C

Aufgrund von Abweichungen zwischen der Örtlichkeit und dem übergebenen Bestand (unvollständige Bestandsaufnahme) ist für

die Strecke 1271 vom Bf Hammerbrook bis zum Bf Neugraben sowie für den Hp Dammtor eine erweiterte Grundlagenermittlung

Bahnstrom durchzuführen. Ziel der Ermittlungen ist die Prüfung der erforderlichen Grundlagen im Gewerk Bahnstrom für die

Realisierung eines betrieblich optimalen 120 s-Taktes sowie die Ermöglichung eines eingleisigen Betriebes im 10 min-Takt bei

Baustellen und Störungen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die DB E&C ist innerhalb der Umsetzung der Leistungsphasen 3/4 mit dem Fachbereich Bahnstrom beauftragt. Innerhalb derangehenden Planung hat sich herausgestellt, dass die Grundlagenermittlung unzureichend stattgefunden hat. Innerhalb derMaßnahme hat sich die DB E&C bereits mit Themen des Gewerkes Bahnstrom vertraut gemacht. Das bereits erworbene Wissenüber die Örtlichkeit und das Gewerk Bahnstrom kann von DB E&C effektiv angewendet werden, um die erweiterte/notwendigeLeistungen bzgl. der Grundlagenermittlung zu führen. Bei einem Wechsel des AN würde dieser Vorsprung verloren gehen. Zudemkann die DB E&C die zu erstellende Grundlagenermittlung nahtlos für die Integration in die Leistungsphasen 3/4 nutzen.
