Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S.2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. 54 - Durch die Ausführung einer Frischbetonverbundfolie (versursacht durch eine Regelwerksänderung) hat sich die Geometrie des Wandanfängers / der Deckenanschlüsse im Rohbau Haltepunkt Marienhof verändert. Die Frischbetonverbundfolie muss während der Bauzeit verwahrt werden, um nach Betonage der Wandanfänger wieder von der Unterseite an diese anschließen zu können.

Diese Änderung der Geometrie bzw. der Profilform des Wandanfängers von einem Stufenprofil zu einem doppelten Dachprofil erforderte eine Änderung der Bautechnik des Wandanfängers durch:

• Ausheben eines Grabens und (zeitweise) Einbringen einer Sauberkeitsschicht des Kickerbereichs

• zeitweise Erfordernis einer Sonderschalung (zusätzlicher Metallkasten im Bereich der Deckenoberseite und zusätzlicher Randabschalung Innenseite des Wandanfängers einbauen und ausbauen)

• Erhöhung der Deckenaufkantung

• Umbau der Fräsanlage durch nachträgliche Änderung der Größe der Auflagetasche.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Herstellung des notwendigen geänderten Wandanfängers durch einen noch zu bindenden Auftragnehmer (AN) ist aus technischen und logistischen Gründen unmöglich, da dadurch massive Probleme durch die entstehenden Schnittstellen zwischen den einzelnen Gewerken entstehen würden.Die Herstellung des Wandanfängers selbst ist technisch zwingend mit den übrigen Herstellungsprozessen des Bauwerks verbunden, da die Arbeiten zeitlich und räumlich auf engstem Raum gleichzeitig durchgeführt werden müssen. Zudem ist eine Trennung der Herstellung des Wandanfängers von der anschließenden Ausführung der Innenschale und des Deckels selbst nicht möglich, da die Gesamtfunktionalität des Bauwerks nur in einem Verantwortungsbereich gewährleistet werden kann, da nur so ein Auftragnehmer auch für die Funktion des Systems verantwortlich ist und dafür haftbar gemacht werden kann.
