Das Synoptische Modell für den Rhein, welches sowohl in Hochwasser- als auch in Mittel- und Niedrigwassersituationen am Rhein im operationellen Betrieb verwendet wird, ist das offizielle Instrument, um die Wirksamkeit der deutsch-französischen Hochwasserschutzmaßnahmen (Kulturwehre, Polder, Dammrückverlegungen usw.) am Oberrhein nachzuweisen. Dazu sind laufend entsprechend den fachlichen Anforderungen umfangreiche Weiterentwicklungen des Modells notwendig. Neu fertiggestellte oder noch in Planung befindliche Ausführungsvarianten für Hochwasserschutzmaßnahmen müssen in das Modell integriert werden, die erweiterten Modellbausteine müssen getestet und optimiert werden, so dass detaillierte Wirkungsnachweise der Maßnahmen geführt werden können und im Hochwasserfall, wie z. B. Mai / Juni 2013 oder die beiden Hochwasser Januar 2018, das Hochwasser optimal vorhergesagt werden kann.

Der Antrag auf Einleitung eines Nachprüfungsverfahrens ist gemäß § 160 Abs. 3 Nr. 4 GWB nur innerhalb einer Frist von 15 Kalendertagen nach Eingang der Mitteilung des Auftraggebers, einer Rüge im Sinne des § 160 Abs. 3 Nr. 1-3 GWB nicht abhelfen zu wollen, zulässig.

Dies gilt nicht bei einem Antrag auf Feststellung der Unwirksamkeit des Vertrages nach § 135 Abs. 1 Nr. 2 GWB. § 134 Abs. 1 Satz 2 GWB bleibt unberührt.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Neben den laufend erforderlichen Arbeiten zur Modellanpassung wurde durch das das Hochwasser in West- und Mitteleuropa 2021 ein zusätzlicher Handlungsbedarf aufgezeigt, dem durch eine Auftragsänderung abgeholfen werden musste. Die zusätzlichen Dienstleistungen, die in den ursprünglichen Vergabeunterlagen nicht vorgesehen waren, können nur durch den ursprünglichen Auftragnehmer erbracht werden. Ein Auftragnehmerwechsel für die beauftragten Zusatzleistungen bedürfte im jetzigen Stadium umfangreicher Einarbeitung in das laufende Projekt und wäre mit einem unverhältnismäßigen zeitlichen und finanziellen Mehraufwand für den Auftraggeber verbunden.
