Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der gebundene AN ist mit der Herstellung des Rohbaus des Hp Marienhof beauftragt. Dies beinhaltet die Herstellung des Dachdeckels sowie aller Ebenen (E-1 bis E-4 und Bodenplatte) inklusive aller erforderlichen Leerrohre für die spätere Installation der technischen Gebäudeausrüstung. Die Beschaffung und den Einbau der Leerrohre an einen weiteren AN zu vergeben, ist technisch nicht möglich. Das Herauslösen einzelner Systeme aus der zu erstellenden Anlage ist nicht möglich, da deren Funktionalität nach Fertigstellung gesamthaft gewährleistet werden muß und damit im Zusammenhang stehende Mängelhaftungsansprüche eindeutig zuscheidbar sein müssen. Durch einen weiteren AN, der vor der Betonnage Teile der Einbauten in die Bewehrung verlegt, wären zudem gegenseitige Behinderungen mit dem gebundenen AN nicht zu vermeiden. Die daraus entstehenden Verzögerungen haben ggf. große Auswirkungen auf den Bauablauf der Hauptbaumaßnahmen und den engen Gesamtterminplan des Großprojektes 2.SBSS München.
