Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Nachtrag 14: Gebäude Hausbruch, DB E&C/Bekanntmachung

Aufgrund eines unerwartet hohen Platzbedarfs im Stellwerk Hausbruch, kann die neue Technik nicht untergebracht werden. Um

dies realisieren zu können, soll ein neues ESTW-Z Modulgebäude sowie eine Netzersatzanlage auf Fremdgrund neben dem

Altbestand geplant werden. Dies Planungsleistung ist zur Erfüllung des ursprünglichen Vertrages notwendig.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die DB E&C ist mit der Umsetzung der Leistungsphasen 3&4 beauftragt, innerhalb welcher sie bereits die Anpassung desbesehenden Stellwerkgebäudes im Planungsumfang hat. Dabei wurde seitens der DB E&C bereits ein Raumprogramm erarbeitet,welches aufgezeigt hat, dass der Platzbedarf im bestehenden Gebäude nicht mehr auskömmlich ist. Die dabei bereitserarbeiteten Erkenntnisse hinsichtlich der räumlichen Ausgestaltung samt Platzbedarf, kann die DB E&C effizient auf die Planungdes neuen ESTW-Z Gebäudes übertragen. Bei einem Wechsel des AN gingen diese Synergieeffekte verloren.
