Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die gemäß ehem. Entwurf entspr. Ausschreibung vorgesehene Entwässerung der Straße ist mit dem bestehenden Bestand nicht umsetzbar. Mit den Lastträger der Stadt fanden Abstimmungen statt. Die Straßenentwässerung ist geteilt zu betrachten. Wasser der rechten Straßenseite (nördl. WL-Seite EÜ) entwässert in den vorhandenen RW-Kanal, Wasser der linken Straßenseite wird gesammelt und in Richtung Vorflut Jüdengrundbach geführt.
