Beauftragt wird eine Erweiterung der Höchstabrufmenge sowie weitere Leistungen bzgl. der bereits vergebenen Softwareentwicklungsleistungen an ein Projekt-/Entwicklungsteam, das nach agilen Maßstäben operieren soll. Dabei handelt es sich um eine Weiterentwicklungsleistung bezogen auf das Bildungsmanagementsystem des Landes Sachsen- Anhalt (BMS-LSA) sowie um Anforderungen des OZG im Bildungssektor.

The works, supplies or services can be provided only by a particular economic operator for the following reason:
- absence of competition for technical reasons

Explanation:

Diese Ex-Ante-Transparenzbekanntmachung bezieht sich auf eine Vertragserweiterung mit dem derzeitigen Dienstleister, an den der Auftrag nach Durchführung eines Vergabeverfahrens vergeben wurde (2023/S 124-390171). Es werden zusätzliche Leistungen beauftragt, wodurch die Höchstabrufsumme steigt. Eine zeitliche Verlängerung finet nicht statt. Die Vertragserweiterung ist zulässig, da bereits keine wesentliche Änderung vorliegt und im Übrigen die Beauftragung der zusätzlichen Leistungen nach § 132 Abs. 2, Nr. 2 GWB zulässig ist. Eine Vergabe an einen weiteren Dienstleister würde zu erheblichen Schnittstellenrisiken sowie zur Gewährleistungsdiffusion führen. Außerdem würde sich das Gesamtprojekt um mindestens drei Monate verzögern und ein zusätzlicher projektinterner Aufwand i. H. einer sechsstelligen Summe würde anfallen.
