Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Umstände, die AG im Rahmen seiner Sorgfaltspflicht nicht vorhersehen konnte:

Im Zuge der 50Hz-Maßnahme wurde auf der Baustelle festgestellt, dass die Lagerfläche im Raum P.U3.025 mit verschiedenen Materialien vollgestellt ist. Die Lagerflächen mussten leergeräumt werden, damit die Arbeiten der 50Hz Maßnahmen weiter ausgeführt werden konnten. Der AG konnte dies nicht vorhersehen, da die Änderung nur auf der Baustelle festgestellt werden konnte. Die Materialien wurden während der Bauzeit in Rahmen eines anderen Projektes von einem anderen Gewerk in den Lagerraum gestellt.

Der Gesamtcharakter des Auftrags bleibt unverändert:

Es bleibt weiterhin bei dem Charakter "Erneuerung der 50 Hz Hauptstromversorgung", da lediglich der folgende Raum entrümpelt wird.
