Zur Überwachung des ordnungsgemäßen Zusammenwirkens der sicherheitstechnischen Anlagen eines Gebäudes wird eine Brandfallsteuermatrix benötigt. Diese koordiniert und steuert alle brandschutztechnischen Sicherheitsanlagen verschiedener Gewerke und ermöglicht die Überwachung der Wirkprinzipprüfung. Sie basiert auf dem jeweiligen Brandschutzkonzept und kann je nach Gebäudeart und -größe sehr komplex werden. Dementsprechend setzt dies viel Wissen über die vorhandenen Technischen Anlagen im Gebäudebestand voraus.

Erst mit Fortschreibung und Genehmigung des Brandschutzkonzepts wird der Umfang Planung für die Brandfallsteuermatrix möglich. Bisher existiert beim Auftraggeber keine vollumfängliche Brandfallsteuermatrix, daher ist zunächst eine Brandfallsteuertabelle als Grundlage für die Fortschreibung der Brandfallsteuermatrix zu erstellen.

Erstellung einer Brandfallsteuertabelle (erforderliche Erweiterung Planungsumfang LPH 5 – Besondere Leistung) als Grundlage für die künftige Fortschreibung der Brandfallsteuermatrix (im regulären Leistungsumfang LPH 8 bereits enthalten)

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Notwendigkeit der Änderung im Zuge des Planungs-/Projektfortschritts, die ein öffentlicher Auftraggeber bei aller Umsicht vorab nicht eindeutig definieren konnte.Die Änderung des Auftrags ohne Durchführung eines neuen Vergabeverfahrens ist nach § 132 Abs. 2 S. 1 Nr. 2 und nach Nr. 3 GWB zulässig. Die Beauftragung eines anderen Auftragnehmers ist aus wirtschaftlichen Gründen nicht möglich. Sie würde zu einem erhöhten Koordinierungs- und Anpassungsaufwand führen.Daneben würde die Beauftragung eines anderen Auftragnehmers auch Unklarheiten bei der Mängelhaftung verursachen. Die Erbringung der zusätzlichen Leistungen durch einen anderen Fachplaner würden im Ergebnis zu Verzögerungen und erheblichen Mehrkosten führen, die in keinem angemessenen Verhältnis zum Wert der Zusatzleistungen stehen. Die Beauftragung des aktuellen Auftragnehmers ist daher schon aus wirtschaftlichen Gründen notwendig.
