Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Art und Umfang der Änderungen (mit Angabe möglicher früherer Vertragsänderungen):

Der Bz 1115 muss umfangreich überarbeitet werden, um die Inbetriebnahme sicherzustellen. Dies bedeutet,

dass das bestehende Gleis Forchheim - Eggolsheim erhalten bleibt und das neue Gleis Eggolsheim Süd -

Forchheim stellwerksseitig teilweise adaptiert werden muss. Ebenso muss die neue westliche Bahnhofshälfte in Eggolsheim in

Teilen adaptiert werden. Dies bedeutet Bezeichnungsänderungen vorzunehmen, Signale, Gleise und Freimeldeabschnitte wieder

in Betrieb zu nehmen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Es handelt sich um Leistungen nach dem IGECON Vertrag B00029. Bei Erbringung der Leistungen durch einen anderen AN

würden unbeherrschbare Schnittstellen entstehen und es würde zu einer massiven Verlängerung des Leistungsablaufs kommen.

Kostenerparnis aus Synergien gingen verloren. Die Planunterlagen können nur durch ein Planungsbüro gleichzeitig bearbeitet

werden.
