Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

MKA110 : Bei den Arbeiten im Oktober/November 2022 sollten die Gleise 1, 2, 4, 7, 8, 10 und 49 gestopft werden.

Aufgrund der erforderlichen Hebe- und Richtwerte waren in den Gleisen 1, 2, 4 und 7 zusätzlich zu den Stopfarbeiten jeweils ein Spannungsausgleich erforderlich. Bei den Gleisen 2 und 4 hätte, aufgrund der dort zulässigen Fahrgeschwindigkeit von 100 km/h, eine temporäre Langsamfahrstelle (La) eingerichtet werden müssen. Die Einrichtung einer La bedarf einer Planung, die

zum Zeitpunkt der Arbeitsausführung nicht zur Verfügung stand. Somit wurden die Arbeiten am 02.11.22 durch die örtliche Bauüberwachung abgemeldet. Der Ausfall betrifft die Arbeiten ‚Spannungsausgleich (SPA)‘ und die dafür erforderliche ‚Schweißüberwachung (SÜ)‘.

Die Leistungen waren zum Vertragsabschluss nicht absehbar und sind dem Grunde nach berechtigt., allerdings zum
