Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Im Hauptvertrag enthalten sind die Erstellung des Bestandsmodells der bestehenden Eisenbahnverkehrsanlagen.

Weiterhin soll im Zuge der Leistung die Auswirkung der geplanten Oberleitung auf bestehendeOberleitungsanlagen, Bauwerke und Zwangspunkte geprüft werden um die Auswirkungen der Vorplanung auf die Bestandsinfrastruktur abschätzen zu können.

Dies Betrifft die Bestandsbereiche Augsburg-Dinkelscherben ;

Burgau und von Unterfahlheim bis Neu-Ulm.

Im Zuge der weiteren Planungen hat sich nach Sicht des AN ergeben, dass die Bestansmodellierung der Oberleitungsanlagen relevant für eine tragfähige und funktionale Planung sind, da nur so die Kosten und zeitlichen Aufwendungen in die Vorplanung einfließen können .

In den vertraglich geschuldeten Trassenplanungen hat sich die Notwendigkeit durch die Optimierung der Trasse ergeben die oben genannten Bereiche der Bestandsoberleitung zu modellieren. Die Auswirkungen auf Kosten und Termine auf die Bestandsoberleitung sind sonst nicht abzuschätzen und nur so wirtschaftlich darstellbar, da nur so die Abhängigkeiten und optimierungen der Bauwerkslage und die optimale Lage der neuen Oberleitungsanlage an die angepasste Trassierung erfolgen kann. Hier handelt es sich um einen interativen Prozess.

Die Leistung Modellierung Bestandsoberleitungsanlagen ist für das vertraglich geschuldete Ergebnis notwendig. Die zu erzielenden Erkenntnisse sind übergreifend nur durch den Generalplaner Lph 1/2 zu erfassen und zu bewerten.

Der Grund liegt in der Abhängigkeiten und Verzahnung der Planung der neuen Oberleitung mit der Bestandsoberleitung und den optimiertrungen der Ingenieurbauwerke für das BIM-Gesamtmodell
