Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Zuge der Planung der EÜ Lübecker Str. durch Erweiterung um einen Überbau ist aufgrund der besonderen Umstände notwendig, die einen weitergehenden Nachweis der Längskraftabtragung hinsichtlich der Schienen erfordern. Diese Leistung zur Schienenspannungsberechnung wurde durch den Nachtrag NT 54 beauftragt. Aufgrund der Erfahrungen aus aktuellen Projekten, in denen ein normativ nicht geregelter Grenzwert ermittelt werden musste, sind für die Erstellung der Schienenspannungsberechnung zusätzliche Leistungen erforderlich, die mit der bisher in NT54 aufgeführten Stundenabschätzung nicht abgedeckt werden. Da die Konditionierung des Oberbaus eine Abweichung von den Standardoberbauform der Ril 820.20210 und Ril 820.2040 erfordert, muss eine betriebsinterne Genehmigung (UiG) beantragt werden. Hierfür sind umfangreichere Betrachtungen und Berechnungen des Oberbaus erforderlich. Des Weiteren sind gewerkeübergreifende Zeichnungen erforderlich, die nicht Gegenstand einer Entwurfsplanung sind. Diese Leistungen waren im beauftragten Nachtrag NT54 nicht vereinbart, sind mithin zusätzliche Leistungen. Die Ausführung dieser Leistung durch einen dritten AN ist unwirtschaftlich und durch den Hauptauftragnehmer kostengünstiger zu erbringen, da dieser ohnehin die Planung der zugehörigen bautechnischen Anlagen ausführt. Die Ausführung dieser Leistung durch einen dritten AN ist planerisch nur mit hohem Aufwand in die Abläufe des Hauptauftragnehmers zu integrieren.
