Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Erforderliche zusätzliche Aufnahme von Schächten als Planungsgrundlage für ein vollumfassendes Schachtkataster im Los 1 - Barrierefreier Ausbau Neustadt (Aisch).

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Zuge der Leistungsstufe 3: Bestandsvermessung wurden unter Pos. 3.5 100 Stk Schächte in der Ausschreibung aufgenommen. Bei der tatsächlichen Aufnahme vor Ort wurden insgesamt 153 Stk und somit 53 Stk Schächte über dem ausgeschriebenen Umfang festgestellt. Die gesamthafte Aufnahme aller Schächte ist für ein vollumfängliches Schachtkataster im Bahnhof Neustadt (Aisch) erforderlich. Da über die Hauptauftragnehmerleistung bereits die BIM-Bestandsvermessung vergeben wurde und der Auftragnehmer somit im Fachbereich Vermessung über weitgehende Kenntnisse im Projekt verfügt entstünden durch einen Auftragnehmerwechsel unausweichlich wirtschaftliche und technische Unannehmlichkeiten im Zuge des weiteren Projektverlaufes.
